The Government of India has implemented the ‘The Right to Information Act 2005’ in order to foster transparency and accountability. This act enables citizens to obtain access to information that is under the control of public authorities, thereby ensuring their right to know. It grants citizens the ability to inspect work, documents, records, certified samples, and even electronic data. This legislation aims to empower individuals by providing them with the means to access crucial information.
The promotion of transparency and accountability among Indian citizens is greatly facilitated by the flow of information. At various levels, public authorities are assigned Central Assistant Public Information Officers (CAPIOs) who receive information requests from the public. The Central Public Information Officer is responsible for providing all necessary information to the public in all administrative units/offices. Requests for information must be resolved within 30 days, either by providing the information or rejecting the request.
Any individual residing in India has the right to file an RTI. To do so, residents must submit a written application or use electronic means in English, Hindi, or the official language of the respective area. Additionally, the application should be accompanied by the appropriate fees as prescribed.
According to section 8(I) (j) of the RTI Act, 2005, and considering the sensitive nature of demographic and biometric data (personal data of residents), only the individual to whom the data pertains has the right to request this information. Any other person or applicant is not authorized to access this information. To safeguard the privacy and confidentiality of residents enrolled in the Aadhaar program, no personal information regarding a third party or any other resident will be disclosed to any other applicant. In certain situations, the applicant may also need to provide further proof of identity for verification purposes.
The necessary steps to file an RTI for Aadhaar related services are as follows:
Step 1:
Access the official website of RTI Online by visiting https://rtionline.gov.in/.
Step 2:
If you are already a registered user, enter your Username and Password. If not, complete the registration process and then sign in.
Step 3:
Proceed by clicking on the ‘Submit Request’ button.
Step 4:
Provide the required details of the public authority. Additionally, you will need to pay the RTI fee of Rs.10 to initiate the transaction.
Step 5:
Click on the ‘Submit’ button.
Step 6:
Choose the preferred payment mode for the transaction.
Step 7:
Once the payment is successfully processed, you will receive a notification on your registered email Id confirming the successful filing of your RTI-Online Request.
There are various categories of RTIs related to Aadhaar that individuals can file under the Right to Information Act, 2005. Some of these categories include:
1. Requesting information regarding the collection and storage of Aadhaar data by government agencies.
2. Seeking clarification on the usage of Aadhaar data by private entities.
3. Obtaining information about the security protocols implemented to protect Aadhaar data.
4. Inquiring about how Aadhaar data is shared with third-party entities.
5. Seeking resolution for grievances related to Aadhaar services.
6. Gathering information about any privacy violations or security breaches associated with Aadhaar.
These are just a few examples, as individuals have the right to file RTIs on any aspect of Aadhaar services they require more information about.
